Student Complaint Procedure

 

Commercial Truck Training Academy is committed to the prompt and equitable resolution of student  conflict issues to the satisfaction of both the student and the college. Students are encouraged to address any  concerns immediately; so that minor problems do not escalate into major problems.

Informal Complaint Procedure 

Should you have any problems or concerns during your training period, we encourage you to discuss them promptly  with the staff member directly involved. The student complaint procedure is designed to provide students with  both an informal and formal process whereby a student may request the review and resolution of a concern if  satisfactory resolution has not been reached by way of the daily problem-solving activities between staff and  students which, in most cases, result in immediate resolution. The student has the right to present his/her case,  either orally or in writing, and be accompanied by an individual of his/her choice at all times during the process. In  addition, the student can ask the individual who accompanies him/her to present the case, either orally or in writing, on his/her behalf. 

Should the resolution to your issue require further involvement, a meeting will be arranged with the college‘s  Administrator, as part of the college’s formal complaint procedure. 

 

Formal Complaint Procedure 

  1. In the case where a student is unable to achieve a satisfactory resolution using the informal direct discussion  approach recommended above, the student can request that a more formal complaint procedure be launched.  To do so, the complaint must be submitted in writing. The student must complete an original Student Complaint  Form, available from the college’s Administrator, stating his/her concern and desired resolution. The student  must sign and submit the original form, along with one signed copy to the college‘s Administrator, who will co sign the forms in Part A to acknowledge receipt of the complaint, return the original to the student, and keep  the copy in the student’s academic file. 
  2. Completed and signed complaint forms may be submitted to the college Administrator in person, mailed to the  attention of the college Administrator, or scanned and emailed to the college Administrator. 
  3. The college‘s Administrator will arrange to meet with the student within two working days of the date of the  written complaint. If, as a result of that meeting, the student and the college‘s Administrator decide to  implement a mutually-agreed-to complaint resolution plan, then that decision, the reason for the decision, and  a description of the resolution plan must be recorded by the college‘s Administrator in Part B on the student’s  original complaint form. The original form must be co-signed by the student and the staff member in subsection  i) of Part B of the form. The original must be returned to the student and a copy must be filed in the student’s academic file. 
  4. The student has the right to present his/her case, either orally or in writing, and be accompanied, by an  individual of his/her choice at all times during the process. In addition, the student can ask the individual  who accompanies him/her to present the case, either orally or in writing, on his/her behalf. 
  5. If the student and the college‘s Administrator reach a mutually agreed to resolution in step 2 above then the  plan must be implemented and the college‘s Administrator must follow up to ensure the resolution plan satisfactorily resolves the concern.
     

Upon mutually satisfactory resolution of the student’s concern, the college‘s Administrator will  meet briefly with the student to close the concern and record in Part B of the original Student  Complaint Form a confirmation that the concern has been satisfactorily resolved. The student and the college‘s Administrator will sign the declaration at the bottom (subsection ii) of Part B. The original form will be given back to the student and a copy will be filed in the student’s academic file. A second copy will be filed in the Campus Student Complaint Binder and kept for 3 years. 
 

Review and Appeal Process 

  1. Where a student concern has arisen that could not be resolved to the student’s satisfaction, through the formal  procedure outlined above, the student may initiate an appeal. The student must complete and sign Part C  (Request for a Review) of the original Student Complaint Form setting out the reasons why the formal procedure  resolution was unsatisfactory. The student will again keep the original form and a copy will be submitted to the college Administrator. 
  2. The college Administrator will form a Student Complaint Committee to investigate the student’s concern and  meet with the student within two (2) working days of the request for a review to discuss resolution. The  committee will consist of a minimum of 3 people including a staff member from the academics department, a  student representative and the campus administrator. 
  3. The Committee will report to the student by completing and signing Part D of the Student Complaint Form within no more than five (5) business days of the conclusion of its resolution investigation process. The written report will include a summary of the investigation findings and the committee’s complaint resolution decision including the reasons for arriving at that decision.
  4. The student will be given the original signed copy of the student complaint form. A copy of the student complaint form will be retained in the student’s academic file and a second copy will be placed in the Campus  Student Complaint Binder, where it will remain for a minimum period of three (3) years. 
  5. Students will be provided with copies of all documentation related to complaints that are submitted to the  college in writing. Such documentation includes, but is not limited to: Student Complaint Forms; any  submissions filed by the student and/or the college; as well as complaint resolution decisions. 
  6. The Campus Administrator will maintain this binder on site for possible annual inspection. 
  7. The period of time between the date the original complaint is submitted in writing by a student and the date a  final decision will be made by the college shall not exceed 10 business days. 
  8. If the student is not satisfied with the college's decision after the review process, he/she can file a complaint with the Superintendent of private career colleges, provided the student is attending a program approved under the Private Career Colleges Act, 2005.

Sexual Violence and Harassment Policy
 

Scope

Commercial Truck Training Academy is committed to providing our students with an educational environment free from sexual violence and treating those students who report incidents of sexual violence with dignity and respect.

 

Purpose and Intent

The students of Commercial Truck Training Academy have the right to study in an environment free of sexual violence.

This document sets out our policy on sexual violence involving our students, defines the prohibited behaviours, and outlines our investigative processes for sexual violence. This policy applies to complaints of sexual violence involving our students - at the campus of Commercial Truck Training Academy or at a one of our events.

 

Definition of Sexual Violence

This policy prohibits sexual violence which means any sexual act or act targeting a person’s sexuality, gender identity or gender expression whether the act is physical or psychological in nature, that is committed, threatened, or attempted against a person without the person’s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism, and sexual exploitation.

 

Policy Objectives

Commercial Truck Training Academy provides this copy of the policy to our students, and educates them together with our career college management, employees, and contractors about this policy and how to identify situations that involve or could progress into sexual violence against our students and how to reduce it.

Where a complaint of sexual violence has been made, under this policy, Commercial Truck Training Academy will take all reasonable steps to investigate it, including the following:

 

  • providing on-campus investigation procedures to students for sexual violence complaints
  • responding promptly to any complaint and providing reasonable updates to the complainant and the
  • respondent about the status of the investigation
  • assisting students who have experienced sexual violence in obtaining counseling and medical care
  • providing students who have experienced sexual violence with appropriate academic and other accommodation
  • providing students who have experienced sexual violence with information about reporting options
     

It is the responsibility of the corporate directors, controlling shareholders, owners, partners, other persons who manage or direct the affairs of Commercial Truck Training Academy, agents, students, instructors, and other employees to report any sexual violence upon becoming aware of incidents or complaints of sexual violence.
 

Reporting and Responding to Sexual Violence

Students and staff of Commercial Truck Training Academy will take all reasonable steps to prevent sexual violence on our career college campus or events by reporting immediately to an Instructor or Manager if our students have been subject to, or they have witnessed or have knowledge of sexual violence involving our students or have reason to believe that sexual violence has occurred or may occur involving our students. Commercial Truck Training Academy, to the extent it is possible, will investigate all reports of sexual violence. Commercial Truck Training Academy will attempt to keep all information disclosed confidential except in those circumstances it believes an individual is at imminent risk of self-harm, or of harming another, or there are reasonable grounds to believe that others on our campus or the broader community are at risk.

 

Commercial Truck Training Academy acknowledges that the victim may choose not to request an investigation by the college and that a victim has the right not to participate in any investigation that may occur. However, in certain circumstances, Commercial Truck Training Academy may be required by law or its internal policies to initiate an internal investigation and/or inform police without the complainant’s consent, if it believes the safety of members of its campus or the broader community is at risk. Anyone involved in the investigation may ask another person to be present during every stage of the process.

 

A student, acting in good faith, who discloses or reports sexual violence, will not be subject to actions for violations of the institution’s policies related to drug and alcohol use at the time the sexual violence took place.

 

During the institution’s investigative process, students who share their experience of sexual violence through disclosing, accessing support, and/or reporting to the university or college, will not be asked irrelevant questions from institution’s staff or investigators, such as those relating to past sexual history or sexual expression.

 

It is a violation of this policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of sexual violence, provided information related to a complaint, or otherwise been involved in the complaint investigation process.

 

Accommodations

Commercial Truck Training Academy will make accommodations to meet the needs of any student effected by sexual violence. The student must contact Sukhjinder Bajwa or a representative of our management team to begin the process. Students are not required to submit a complaint or formal report of a sexual violence incident to request accommodations.

 

Commercial Truck Training Academy will determine an appropriate accommodation on a case-by-case basis at no cost to the student.

 

Investigating Reports of Sexual Violence

A complaint of sexual violence may be filed under this policy, by any student of Commercial Truck Training Academy, to Sukhjinder Bajwa, Director in person or by emailing ctta401@gmail.com. A management representative of the college will be involved in each stage of an investigation and decision-making process.

 

Upon a complaint of alleged sexual violence being made Commercial Truck Training Academy will initiate an investigation, including the following:
 

  • meeting with the complainant to determine the date and time of the incident, the persons involved, the names of any person who witnessed the incident and a complete description of what occurred
  • determining whether the incident should be referred immediately to police
  • determining what interim measures, if any, need to be taken during the investigation (for example: remote classroom)
  • interviewing the complainant, any person involved in the incident and any identified witnesses
  • interviewing any other person who may have knowledge of incidents related to the complaint or any other similar incidents
  • informing the respondent of the complaint, providing details of the allegations, and giving the respondent an opportunity to respond to those allegations
  • providing reasonable updates to the complainant and the respondent about the status of the investigation
  • determining what disciplinary action, if any, should be taken
     

To ensure procedural fairness Commercial Truck Training Academy will include the following elements in any investigation and its decision-making process:

 

  • Processing without undue delay
  • The right to fair and impartial decision-making
  • The Complainant’s right to be heard
     

Disciplinary Measures

If it is determined by Commercial Truck Training Academy that a student of our college has been involved in sexual violence, immediate disciplinary or corrective action will be taken up to and including termination of employment of instructors or staff or expulsion of a student.

 

In cases where criminal proceedings are initiated, Commercial Truck Training Academy will assist police agencies, lawyers, insurance companies, and courts to the fullest extent.

 

Where criminal and/or civil proceedings are commenced in respect of allegations of sexual violence Commercial Truck Training Academy may conduct its own independent investigation and make its own determination in accordance with its own policies and procedures.

 

Appeals

Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the owner of Commercial Truck Training Academy within ten days by submitting a letter addressed to the owner advising of the person’s intent to appeal the decision.

Policy Review

This policy is reviewed every three years, at the time of review input from students will be taken into consideration. This policy will be reviewed again in April 2026.

 

 


Student Expulsion Policy 

This Private Career College is committed to taking all reasonable steps to ensure the students have the opportunity  to successfully complete their programs. The College has a commitment to ensure that within this general  framework that all students are treated fairly and equitably. Students who do not support the academic and ethical  goals of the College for themselves and their fellow students may be subject to penalties, up to and including  expulsion. 
 

In general, the College will attempt to resolve a situation without expulsion. Verbal warning, written warnings and  suspension may precede this final and most serious of actions. Where the College deems the integrity, safety or  well-being of the College, students, staff, clients, visitors and other guests is in danger then expulsion may be applied  at the College’s discretion at any point in the process. 
 

The following outlines the conditions under which a student may be expelled with cause: Academic Dishonesty
 

Students may be subject to expulsion at the discretion of the College for academic dishonesty. Academic dishonesty  is any word, action or deed performed alone, or with others for the direct or indirect intention of providing an unfair  advantage or benefit to self or other student(s) including: 

  1. cheating 
  2. plagiarism 
  3. unapproved collaboration d. alteration of records 
     

Outstanding Fees 

  1. bribery 
  2. lying 
  3. misrepresentation 
     

Failure to pay overdue accounts owing to the college within the specified period may be grounds for expulsion after  a written warning has been given. 
 

Conduct 

In the event of student misconduct, the issue will initially be dealt with between staff and the students. If such  misconduct has the potential to result in physical harm to persons or property of the College, or the misconduct is  repeated, the College may expel the student at the College Administrator’s discretion. 
 

Any student found under the influence of drugs or alcohol, or carrying a weapon, will be subject to immediate  expulsion. 
 

Omissions or Errors in Admissions Documentation 

The College has a responsibility to ensure students have been admitted in accordance with the registration  requirements for the program. Students who knowingly misrepresent their applications are subject to immediate expulsion. 
 

Academic Failure 

A student who fails to achieve the required academic standing in a programs may be expelled from the program.  The College may at its discretion offer alternatives to a student.
 

Attendance 

A student who does not achieve the required attendance is subject to expulsion. 
 

Harassment or Discrimination 

The College does not condone harassment or discrimination of any student, staff, client, or visitor to school  premises. A student participating in harassing or discriminatory activities that are racial, sexual, or pertaining to  sexual orientation in nature may be subject to immediate suspension or expulsion depending on the severity of the  activity and pending an investigation. 

Any student, who is deemed by the investigation to have engaged in harassing or discriminatory activities, may be  expelled at the discretion of the College Administrator, depending on the severity of the activity. 
 

Racial harassment means bothering, threatening, or treating someone unfairly because of their race, colour,  ancestry, birthplace, religious belief, ethnic background, citizenship, or language. 
 

Sexual harassment means bothering someone by saying or doing unwanted or unwelcome things of a sexual or  gender-related nature including touching inappropriately, making offensive jokes about women and men, making  sexual suggestions or requests, staring at or making unwelcome comments about one’s body, displaying sexually  offensive pictures, or being verbally abusive because of one’s gender. 
 

Sexual orientation harassment means treating someone unequally because they are gay, lesbian, heterosexual,  bisexual, or living in a same-sex relationship. This could include making a hurtful comment or action to an individual  that is known or ought to be known to be unwelcome, making Homophobic jokes or hints about a person’s sexual  orientation or same-sex partnership status, or displaying of disrespectful signs, caricatures, cartoons or graffiti. 
 

In determining what constitutes harassment or discrimination, The College will refer to the Ontario Human Rights  Code. Students requiring more specific information may refer to the specific code as posted on the Provincial web site (http://www.ohrc.on.ca/en/ontario-human-rights-code).  
 

Misuse of College Property 

Students who damage, misuse, steal or otherwise use the property in a way that is prohibited may be expelled and  required to make restitution. 
 

Endangerment of Staff or Students 

The College is committed to the right of all College staff, students, clients and visitors to be safe. Students who by  action or neglect in any way endanger the safety of themselves or others may be expelled. 
 

Prior to expulsion, depending on the severity and nature of the situation, the College may take intermediate steps  at its discretion including:  
 

  1. verbal warning  b. written warning  
     

Notification 

  1. suspension  d. expulsion. 
     

A student who is subject to expulsion for any reason will be notified in writing, either hand delivered or by registered  mail with return receipt. The College is not responsible for non-delivery by registered mail if the student has not  provided a valid home address where the student currently resides.
 

The notification will contain a description of the basis for expulsion and the effective date. Expelled  students who dispute the facts of the expulsion and wish to appeal must appeal the decision in  writing within one week of the notification by following the college’s student complaint procedure provided to the  student and by providing sufficient proof to support the complaint. 
 

A Student whose expulsion is upheld after having followed the college’s student complaint and appeal procedure,  may file a further appeal through the Complaints process of the Ministry of Training, Colleges and Universities,  provided the students are attending a program approved under the Private Career Colleges Act, 2005. 
 

If a student’s appeal is successful and he/she is eventually reinstated as part of the internal college or Ministry  appeal processes, than the college will arrange for the student to make up the training time that he/she had missed  since the date of expulsion specified in the written notification. 
 

Fees 

Settlement of a student’s account, for a student that has been expelled, will be completed under the College’s Fee  Refund Policy, using the effective date of expulsion as the final day of attendance in their program of study. 
 

Return of Property 

A student who is expelled is responsible for the return of any College property in his/her own possession within 10  days of the expulsion and will be held financially responsible for any property not returned in good condition or as  outlined in the student contract (as prescribed in the Private Career College Act, 2005 and O. Reg. 416/06).
